This half day course on ASB, Mental Health and the Equality Act is being delivered by Cathy Chattaway of Green and Burton and aims to demystify the complex area of ASB case management.

One of the biggest challenges that prevents ASB cases from progressing to resolution is where the person causing the harm has poor mental health. Few officers managing ASB case work will have formal qualifications in mental health law and practice, making it difficult to decide whether action can or should be taken.

Where action is determined appropriate against someone with poor mental health, equality act challenges can sometimes follow. It is vital the officer understands the duties within this legislation and the practical case management steps they can undertake to mitigate these defences and ensure the most informed decision is being taken in a case.

Course Details

Learners will explore:

• The differences to the case management process when a person causing ASB has poor mental health
• Understanding the legal position with regards legal action
• Understanding the right questions to ask the right people
• The common equality act challenges (disability discrimination and breaching the public sector equality duty) and how to best overcome these
• The importance of proportionality/equality act assessments
• Partnership working, including with public health and the voluntary sector
